Fire Risk Assessment
On the 1st December 1999, amendments to the Fire Precautions (Workplace) Regulations 1997 made it a CRIMINAL OFFENCE for any business not to have a written fire risk and emergency plan for their premises.
Key Points:
A fire risk assessment is defined here as "a process for identifying fire hazards and determining the likelihood (risk) that such hazards will result in a fire".
The main reason to carry out fire risk assessments is to comply with legislative requirements, namely those contained in the Fire Precautions (Workplace) Regulations 1997 (FPWR) (as amended) and the Management of Health and Safety at Work Regulations 1999 (Management Regulations).
The ultimate aim of fire risk assessment is to identify the action that needs to be taken to reduce and/or control the risks. It is a management responsibility to implement this action.
The fire risk assessment will be more effective if it is conducted as a separate exercise to health and safety risk assessments.

THE REGULATION
Requires an assessment to be made of the risk to people in the event of fire, and for this assessment to be reviewed and kept up to date.
NON COMPLIANCE
A deliberate failure to do this, (which places any person at serious risk), is a criminal offence. Ignorance is no defence.
THE ENFORCEMENT
It shall be the duty of every fire authority to enforce within their area. Brigade enforcement officers to visit premises and inspect the Risk Assessment.
